September Indictments: Capital Murder, Sexual Assault and Firearm Smuggling

 

SAN ANGELO, TX – For the month of September, a grand jury in Tom Green County indicted 60 people. As usual, drugs topped the list of indictments, but so did aggravated assaults with weapons.

Of course, there are always the more noteworthy cases that our readers are familiar with, including a capital murder case and a sexual assault perpetrated by a man missing one arm.

16-Year-Old Charged in Capital Murder of Multiple Persons

On Sept. 7, a grand jury indicted 16-year-old Nicholas Abel Rodriguez in the Capital Murder of Zane Lopez and Juan Guerrero. Rodriguez is being charged as an adult in this case.

According to the official complaint, San Angelo Police Officer Charles Barker was dispatched to the 1100 block of East 22nd St, for a reported shooting. When Barker arrived, he observed two males, identified as Lopez and Guerrero, lying on the ground in the back yard of the residence. Both had gunshot wounds to the head.

One victim was transported to Shannon Hospital, but the other was deceased and left at the scene.

SAPD Detective Carlton T. Kolbe met with Joe Lopez, Zane Lopez’s father, who told the detective that he and his son were inside the residence. Zane, however, went out the back door, and a short time later, Joe told Kolbe he heard what sounded like firecrackers.

“Joe Lopez said he went outside and saw Zane Lopez and another male laying on the ground in the back yard,” said the complaint. “Joe Lopez told [Kolbe] that Zane Lopez was transported to Shannon Hospital by ambulance.”

Kolbe also observed .40 and .45 shell cases in the alley behind the residence.

Rodriguez, for his role in the crime, faces the charge of Capital Murder of Multiple Persons, a capital felony, along with co-defendants Fred Garcia, Gilberto Reyes and Erick Ramos. His bond is set at $500,000.

Sexual Assault of a San Angelo Woman by One-Armed Man

Also included in the September 2016 indictments was Bolivar Dean Newkirk, 38, charged with Sexual Assault, a second degree felony enhanced to first degree.

Court documents state that Newkirk, on or about July 3, 2016, “intentionally and knowingly” caused the sexual “penetration” of his female victim without her consent.

The complaint said SAPD officers were dispatched to the Stripes on N. Bryant and 19th St. They learned a male with one arm driving a green van had used the bathroom at the Stripes, and then he went to the Whataburger parking lot across the street. He was deemed “suspicious” at the time.

Officer Dietz and Officer Green, who responded to the Whataburger on Bryant, said Newkirk looked out of the bathroom and then closed the door.

The officers waited outside the bathroom, and when the man finally exited, they asked Newkirk if he was driving the green van in the parking lot. Newkirk responded, “Yes.”

Officer Green said Newkirk then left and walked to Lowe’s Grocery Store at 1926 N. Bryant. Officer Dietz called the store to see if Newkirk had been seen entering the store, but was told no. However, Officer Dietz was told that someone had reported screaming from the women’s bathroom.

“As Officer Dietz was driving to Lowe’s Grocery store, he was told that a one-armed male defendant had run out of the store,” said the complaint.

Officer Dietz said he arrived at the Lowe’s and opened the women’s bathroom door. He saw the victim in the reflection of the mirror, clothed only in a bra. When the officer asked the victim what happened, she told him that someone tried to rape her.

The victim described the male as wearing the same clothes as Newkirk, and she said the suspect did not have a left arm. The victim also said her phone had been taken, and Officer Dietz located her clothes in an aisle at the store.

The victim told officers while she was washing her hands, a male subject opened the bathroom door at Lowe’s, and then he closed it. As she walked toward the door to leave, Newkirk walked into the bathroom. At that point, Newkirk began punching the victim in the head and her face. Officials noted that they did see dry blood on the victim’s lips, as well as swelling to the corner of her left eye.

The victim also said she was knocked to the ground and Newkirk drug her by her hair to a bathroom stall. Once there, Newkirk demanded the victim take off her clothes. The victim did so and Newkirk turned her around against the bathroom stall. Newkirk then proceeded to sexually assault her. However, the victim said Newkirk didn’t completely “penetrate her.”

Instead, he fled with her phone and her clothing.

Officials later located Newkirk in the unit block of W. 18th St. They found the keys that belonged to the green van parked at Whataburger, and they located an empty/open condom package, and one sealed condom package.

According to the complaint, the victim was transported to Community Hospital for observation.

The complaint also noted that Newkirk appeared to be under the influence of a narcotic, so no statement was taken due to “his mental state.”

In addition to the sexual assault, Newkirk is being charged with Possession of Methamphetamine. His bond is set at $75,000.

Firearm Smuggling

Also in September, Felix Antonio Pina, 20, was indicted for firearm smuggling.

According to the indictment, Pina, on or about April 27, 2016, “knowingly” engaged in the business of transporting or transferring a firearm that the defendant knew was acquired in violation of State of Texas laws.

This charge is a third degree felony, and Pina’s bond is set at $10,000.
