SAN ANGELO, TX — A San Angelo woman was arrested after lying under oath in the 340th Judicial District Court.
Kimberly Martinez, 19, was arrested by the Tom Green County Sheriff’s Office for aggravated perjury.
According to court documents, on Oct. 8, 2025, Martinez appeared in court for a Child Protective Services case, where Judge Elizabeth Watkins was the presiding judge.
During the hearing, Martinez was called to the stand and duly sworn in prior to testimony. During her testimony, Martinez testified that she was not currently pregnant at the time when asked.
On Jan. 28, 2026, the investigator received the official transcript of the court proceeding. On page 14, attorney Christine Rankin said to Martinez, “And are you currently pregnant?” to which Martinez replied, “No."
That same day, the investigator obtained medical records for Martinez from Shannon Medical Center. A doctor met with Martinez on July 15, 2025, and treated her, noting, “She (Martinez) is currently 11 weeks and 5 days pregnant."
Then, CPS was contacted by the investigator, and they stated Martinez had given birth on Jan. 12, 2026, in Midland County. The Midland County Clerk’s Office was contacted and advised there was a birth certificate on file.
Martinez was arrested on Jan. 30, 2026, and was released later that same day on $35,000 bond. Aggravated perjury is a third-degree felony and occurs when a person intentionally makes a false, material statement under oath during or in connection with an official proceeding. Unlike standard perjury, which is a Class A misdemeanor, aggravated perjury involved lies that could directly impact the outcome of a court case or official investigation.
