Lawsuit Filed Over Fall at Cork & Pig in San Angelo

 

SAN ANGELO, TX — A Bexar County woman has sued a San Angelo restaurant, alleging she suffered injuries after slipping and falling on a handicap ramp while wearing plastic bags on her feet that employees had placed there. 

Rox Ann Gonzalez filed the lawsuit in the 391st Judicial District Court in Tom Green County. The suit names Cork & Pig Tavern – San Angelo, LLC as the defendant. 

According to the First Amended Petition filed in June 2025, the incident occurred on or about May 12, 2023, at the restaurant located at 1407 Knickerbocker Road. Gonzalez was at the establishment with her mother and stepfather when it began raining. She left to retrieve her vehicle and was given plastic bags by employees to place over her sandals to keep her feet dry. 

The petition states Gonzalez initially refused to wear the bags multiple times but eventually did so at the employees’ insistence. She then slipped while walking down the handicap ramp, fell, and struck her head on the concrete. The suit alleges the plastic bags created a dangerous condition and that the restaurant failed to warn her or maintain safe premises. 

Gonzalez claims she suffered bodily injuries and is seeking damages between $250,000 and $1 million for past and future medical expenses, physical pain, mental anguish and physical impairment. 

The restaurant, through its attorneys, filed an Original Answer denying the allegations. The defendant raised several affirmative defenses, including contributory negligence, assumption of the risk, failure to mitigate damages and that any hazards were open and obvious. 

The case is scheduled for a motion to compel hearing on July 10 before Judge Brad Goodwin in the 391st District Court. A pretrial hearing is set for Nov. 2, with jury selection scheduled for Nov. 16.
