San Angelo Tractor Supply Project Sparks $45K Lawsuit

 

SAN ANGELO, TX — A South Carolina construction company has sued two firms in Tom Green County district court, claiming it is still owed $45,100 for work on a Tractor Supply remodel project in San Angelo.

The original petition was filed July 24, 2024, in the 391st Judicial District Court against GRB Service Systems Inc., doing business as Southwestern Services, and Sunset Crossing LLC. 

Court documents state Bracker Construction LLC provided the services and materials under a contract with Southwestern. The filing notes the contract identified Tractor Supply Company as the property owner, but real estate records list Sunset Crossing LLC as the owner. 

Bracker alleges it submitted invoices totaling $45,100 that remain unpaid. It filed the required affidavits to perfect liens against the property under Texas Property Code. The suit claims breach of contract and fraud, alleging Southwestern falsely represented it would pay for the work. 

It also seeks recovery under quantum meruit, a Latin legal phrase meaning "as much as one has deserved." It is a legal doctrine that allows a party to recover the reasonable value of services rendered or materials provided, even if there was no enforceable contract or predetermined price. 

Along with the $45,100, the petition asks for prejudgment and post-judgment interest, reasonable attorney fees, court costs and foreclosure of liens on their property.

GRB Service Systems Inc. filed its original answer and jury demand on Sept. 10, 2024. The answer generally denies every allegation and raises multiple affirmative defenses, including that the liens are invalid for failure to meet strict requirements under Texas law and that Bracker failed to mitigate its damages. The defendant also demands a jury trial and seeks to recover its own attorney fees and costs from the plaintiff. 

According to court records, the case remains pending in the 391st Judicial District Court. GRB Service Systems Inc. d/b/a Southwestern Services was served in August 2024 and filed its answer the following month. Sunset Crossing LLC has not been served. The court referred the case to mediation in January 2026. A pre-trial hearing is scheduled for July 31, 2026, with a jury trial set for Aug. 17, 2026, before Judge Brad Goodwin.
