SAN ANGELO, TX — A San Angelo man has been sentenced to life in prison after a jury found him guilty on multiple counts stemming from a 2022 shooting and standoff with police.
A jury convicted 41-year-old Luis Alberto Herrera of five counts of assaulting a peace officer with a deadly weapon following a trial that began Dec. 15 and was presided over by 340th District Judge Jay Weatherby.
Herrera also faced one count of aggravated assault with a deadly weapon causing serious bodily injury to a household member and four counts of aggravated assault with a deadly weapon against a public servant, prosecutors said.
On Jan. 16, 2022, Herrera entered a San Angelo residence and shot a woman in the back. He then fled the scene and barricaded himself inside an RV located a few blocks away.
A standoff lasting approximately four hours followed, during which Herrera fired an assault rifle at police officers at least eight times.
After hearing testimony and reviewing evidence, the jury deliberated for about 1.5 hours before finding Herrera guilty on all charges. Herrera elected to have the jury assess his punishment.
During the punishment phase, the State called victims to testify about how the assaults affected them. The woman who was shot testified that she learned Herrera had an inappropriate relationship with her 14-year-old daughter and kicked him out of the home. She also told jurors Herrera continued returning to her residence and pointed a gun at her on at least two occasions.
Law enforcement officers involved in the standoff testified they feared they might not see their families again during the incident, prosecutors said.
The jury sentenced Herrera to life in prison and imposed a $10,000 fine on each count, the maximum punishment allowed. The district attorney’s office stated the punishment range for the offenses was five to 99 years or life in the Texas Department of Criminal Justice Institutional Division, along with fines of up to $10,000 per offense.
