Attorneys Waiting for DNA Results in Capital Murder Case

 

SAN ANGELO, TX – This morning, Fernando Lavaris, Jr., 30, appeared in court for another Criminal Pre-Trial in Judge Barbara Walther’s 51st District Court.

Lavaris is facing charges of Capital Murder after a burglary gone wrong in September of 2015, killing 69-year old William Valdez. Lavaris and three others were arrested and indicted in the death of Valdez.

On October 21, Lavaris appeared in court where the district attorneys and defense attorneys addressed scheduling details and seven motions entered by the defense. During today’s pre-trial, Lavaris’ next pre-trial was scheduled for December 9 where the court will finalize trial dates for Lavaris.

Initially, Lavaris’ trial date was set for February 4, 2017, but, as of today, both the prosecution and defense are waiting for DPA’s DNA analysis results to return, as well as Judge Woodward’s court schedule. Walther is set to preside over Lavaris’ trials and other criminal cases, making it hard to schedule a set date at the current time.

The Pre-Trial ended today with Judge Walther entering a private meeting with the defense. The December 9 pre-trial will confirm if Lavaris can keep his scheduled February 4 trial date, or if it will be moved to late March or Early April.
